All services provided by Webhostxpress.net must comply with our Acceptable Use Policy (AUP).

Content:
All services provided by Webhostxpress.net may be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any United States Federal, State or City law is prohibited. This includes, but is not limited to: copyrighted material, material we judge to be threatening or obscene, unlicensed software or files, or material protected by trade secret and other statute. The subscriber agrees to indemnify and hold harmless Webhostxpress.net from any claims resulting from the use of the service which damages the subscriber or any other party.

Examples of non-acceptable content or links
* Pirated software
* "Illegal MP3's"
* Hackers' programs or archives
* Warez Sites
* Child Pornography
Webhostxpress.net will be the sole arbiter as to what constitutes a violation of this provision.

Unlimited Visitors/Hits & Server Resource Usage:
Webhostxpress.net offers its clients unlimited visitors/hits. Unlimited visitors/hits refers to the number of visitors to your website, NOT the amount of bandwidth. Your account is still limited to the amount of bandwidth specified with your package. To maintain the integrity of our service the following usage limitations apply:
* Sites with banners, graphics or cgi's running from their domain being used on other domains.
* Sites running large chat room gatherings.
* Sites using more than 20% of system resources
If you do not qualify, you maybe be required to upgrade your package. Webhostxpress.net is the sole arbiter as to what constitutes a violation of usage limitations. If you go over your allotted bandwidth in that given month, you will be required to pay per GB($2.00) of overage with the next bill. Your website can be moved at anytime to another server to reduce load on the current server.

Background Processes/Programs
Webhostxpress.net may allow programs to run continually in the background, these are considered on a one to one basis and an extra charge may be incurred based on system resources used and operational maintenance needed.

IRC:
Webhostxpress.net does not allow IRC or IRC bots to be operated on our regular servers. Please e-mail info@webhostxpress.net for more info on this type of hosting.

Commercial Advertising - Email:
Spamming, or the sending of unsolicited email, from an Webhostxpress.net server or using an email address that is maintained on a Webhostxpress.net machine is STRICTLY prohibited. Webhostxpress.net will be the sole arbiter as to what constitutes a violation of this provision. Opt-In email is acceptable, as long as Opt-Out/Removal request are fully honoured. Please make an effort to limit outgoing mail on your account to no more than 1000 pieces per hour. Large mailings are preferred to be sent from the hours of 12AM - 8AM EST.

Refund Policy:
Webhostxpress.net is proud to offer its customers a 14 day money-back guarantee. If cancellation is made within the first 14 days of service all hosting fees will be refunded. This does not include fees for domain registration or setup fees. Refunds on cancelled hosting accounts with the yearly payment term after the 14 day money back guarantee has expired are handled on a case by case basis. Typically, you will be charged the standard monthly fee for the time you remained a customer, and will be refunded the remaining credit.

Cancellation:
Cancellation can be made at any time via email to: cancel@webhostxpress.net. Although no notice is required, and there is no cancellation fee, all fees paid for service up to the notice of cancellation are non-refundable. Refunds on cancelled hosting accounts with the yearly payment term are handled on a case by case basis. Typically, you will be charged the standard monthly fee for the time you remained a customer, and will be refunded the remaining credit.

Billing:
The first payment is due on the signup date. Subsequent payments are due once a month on the day you signed up(for monthly payment terms), or once a year on the day you signed up (for annual payment terms).

Server Abuse:
Any attempts to undermine or cause harm to an Webhostxpress.net server or customer of Webhostxpress.net is strictly prohibited. Webhostxpress.net will pursue legal action to the fullest extent for all abuse of the Webhostxpress.net Network.

Suspension/De-Activation:
If any terms or conditions are failed to be followed it will result in grounds for account suspension or de-activation. Webhostxpress.net reserves the right to remove any account without prior notice. If Webhostxpress.net deactivates your account(s) for violating policy, you will forfeit your rights to a refund and none will be given. No refunds for advance payments, on de-activated accounts. Normal policy is a warning first, and account de-activation the second offense. Serious offenses may cause immediate de-activation.

Refusal of Service:
We reserve the right to refuse, cancel, or suspend service at our sole discretion.

These terms may be modified at any time and without notice. All users previous and new are always subject to the newest terms posted here at all times.
